Abstract

Criminal traffic accident that frequently happened in our society can have a subject and a victim. The existence of subject or victim can be caused by a mistake, in this case is dereliction of the vehicle users. Criminal traffic accident is not only caused by the vehicle user or the bigger vehicle, but also from the dereliction of the victim, so that in the responsibility decision in Law number 22 2009 year about Traffic and Public Transportation, it needs some formulation policy to get the justice and also law certainty to get it and also the law certainty related to the law of responsibility for Criminal Traffic Accident.
